Welcome to PixelMax, an AI-powered image editing service ("Service") operated by PixelMax ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and PixelMax.

Please read these Terms carefully before using the Service. If you do not agree with any part of these Terms, you must discontinue use of the Service immediately.

PixelMax is an AI-powered image editing platform that enables users to enhance, transform, and edit images using advanced machine learning models. We provide both free and premium tiers:

• Free Plan: Core AI editing features with a limited monthly credit allowance. Processed images are stored for up to 3 days.
• Lite / Pro / Ultra Plans: Enhanced capabilities including higher monthly credits, priority processing, extended image storage, and access to advanced AI models.
• Credit Packs: One-time purchases of permanent credits that never expire, available as add-ons to any plan.

Available AI editing operations include, but are not limited to: background removal, relighting, image upscaling, object removal, style transfer, image restoration, advanced inpainting, and other AI-assisted image enhancement operations made available through the Service from time to time.

3.1 Nature of AI-Generated Content

PixelMax uses artificial intelligence and machine learning technology to process and edit images. This is emerging technology that operates based on statistical patterns and probabilistic inference. Unlike traditional deterministic software, AI editing produces results that may vary with each request. For a complete list of our AI models and service providers, please refer to Section 4 below.

3.2 No Guarantee of Results

WE MAKE NO GUARANTEES regarding:

• Exact match to your expectations or creative vision
• Consistency across multiple editing sessions with identical inputs
• Precise preservation of specific facial features, identity, or artistic style
• Accuracy of fine details within edited images
• Suitability of output for any particular professional or commercial purpose

3.3 Output Variability

Each AI editing operation is a probabilistic process. Results may vary significantly between attempts, even with identical inputs and settings. This variability is an inherent characteristic of AI image processing technology and is not specific to PixelMax.

3.4 Free Tier for Evaluation

We provide a free usage tier so you can thoroughly evaluate our Service quality and AI capabilities before purchasing a subscription or credit pack. By choosing to subscribe or purchase credits after using the free tier, you acknowledge that:

• You have evaluated the AI's capabilities and understand its technological limitations
• You accept the current state of AI image editing technology and its inherent variability
• You understand that paid features primarily enhance credit allowance, processing speed, and storage duration — not fundamental AI accuracy or consistency

By using our Service, you agree to:

• Use the Service in compliance with all applicable laws and regulations
• Not attempt to circumvent any limitations, security measures, or access controls
• Not use the Service for any illegal, harmful, or unauthorized purposes
• Not interfere with or disrupt the Service, servers, or networks connected to the Service
• Not generate, upload, or distribute content that violates third-party intellectual property rights
• Not upload images of real individuals without their consent or use the Service to manipulate a real person's identity, likeness, or appearance in a misleading, deceptive, or harmful way
• Not attempt to reverse-engineer, decompile, or extract the underlying AI models or proprietary algorithms
• Not share your account credentials or allow unauthorized third parties to use your account

6.1 Your Content

You retain ownership of any images you upload to the Service ("Input Content"). By uploading images, you grant us a limited, non-exclusive, royalty-free license to process your Input Content solely for the purpose of performing the requested AI editing operations.

6.2 Edited Output

AI-edited images produced from your Input Content ("Output Content") are provided for your personal and commercial use. You are responsible for ensuring that your use of Output Content does not infringe on any third-party rights, including the rights of individuals depicted in the original images.

6.3 Our Intellectual Property

The Service, including its software, user interface, design, AI models, and all associated documentation, is and remains the exclusive property of PixelMax and its licensors. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

Our privacy practices are described in detail in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of information as described in our Privacy Policy. We store uploaded images only for the duration necessary to complete your requested AI operations and for a short retention period thereafter, as specified in your plan.

While we strive to maintain continuous Service availability, we do not guarantee uninterrupted or error-free access. We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service at any time
• Perform scheduled or emergency maintenance
• Update, replace, or remove AI models or editing features
• Impose usage limits or throttle access in response to unusual demand or to protect service integrity

We will make reasonable efforts to provide advance notice of planned maintenance. Scheduled downtime does not entitle users to a refund unless the total cumulative downtime in a billing period exceeds 24 consecutive hours due solely to our platform failure.

You agree not to upload, process, or generate content that:

• Violates any applicable laws, regulations, or legal requirements
• Is hateful, discriminatory, defamatory, or offensive toward any individual or group
• Infringes on intellectual property rights, trademarks, or copyrights
• Is sexually explicit, pornographic, or contains nudity without appropriate authorization
• Is intended to harass, threaten, abuse, or cause harm to others
• Depicts real individuals (especially minors) in a false, misleading, or harmful context without their explicit consent
• Contains malware, viruses, or other malicious code

We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts that repeatedly or egregiously violate them, without prior notice and without refund.

10.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SATISFACTORY QUALITY. WE DISCLAIM ALL WARRANTIES ARISING FROM ANY COURSE OF DEALING OR TRADE USAGE.

10.2 No Warranty of Output Quality

WE EXPRESSLY DO NOT WARRANT THAT:

• Edited images will meet your specific requirements, expectations, or creative vision
• The quality, accuracy, or consistency of AI outputs will satisfy your needs
• Any errors, limitations, or defects in the AI models will be corrected
• The Service will be uninterrupted, secure, or error-free

10.3 User Assumption of Risk

You acknowledge that AI image editing technology is inherently probabilistic and experimental. You voluntarily assume all risks associated with the use of the Service and any AI-generated output. Any reliance on the Service's outputs for commercial, professional, or personal purposes is at your sole risk and discretion.

10.4 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, our total aggregate liability for any and all claims arising from your use of the Service shall not exceed the total amount you actually paid to us in the twelve (12) months immediately preceding the event giving rise to the claim. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill.

PixelMax offers paid subscription plans (Lite, Pro, Ultra) and one-time credit pack purchases to enhance your AI editing experience.

11.1 Billing and Renewal

• Subscription fees are charged at the beginning of each billing period (monthly or yearly) according to your chosen plan
• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date
• Prices are subject to change with 30 days advance notice to existing subscribers; new prices apply to subsequent billing periods
• Credit packs are one-time purchases and are not subject to recurring charges

11.2 Refund Policy

As an instant-access digital service, ALL SUBSCRIPTION PAYMENTS AND CREDIT PACK PURCHASES ARE NON-REFUNDABLE once processed. This policy applies to, but is not limited to:

• Dissatisfaction with AI-edited image quality, style, or consistency
• Unmet expectations regarding output accuracy or results
• Failure to achieve specific creative goals or desired outcomes
• Unused credits, generation quota, or remaining subscription time
• Change of mind, accidental purchase, or buyer's remorse after subscription activation

11.3 Refund Exceptions

Refunds may ONLY be considered in the following limited circumstances:

• Verified technical billing errors such as duplicate charges or incorrect charge amounts
• Complete and prolonged inability to access the Service due to our platform failure (not user-side issues)
• Refunds specifically required by applicable consumer protection laws in your jurisdiction

11.4 Cancellation Policy

• You may cancel your subscription at any time through your account dashboard or by contacting support
• Cancellation takes effect at the end of the current paid billing period
• No pro-rata refunds are provided for partial or remaining billing periods after cancellation
• You retain access to paid plan features until the end of your current paid period

11.5 Credits

Monthly subscription credits expire at the end of each billing period and do not carry over. Credit pack credits (one-time purchases) are permanent and do not expire. Credits are non-transferable and have no cash value.

10.6 Goodwill Credits

At our sole discretion, we may offer bonus credits as a goodwill gesture for documented service issues. Such credits are not transferable, not redeemable for cash or refund, do not constitute an admission of fault or liability, and are provided on a case-by-case basis at our absolute discretion.

12.1 Informal Resolution

Before filing any formal claim or dispute, you agree to first contact us at support@pixelmax.art to attempt informal resolution. We are committed to addressing your concerns promptly and fairly. Most issues can be resolved quickly through direct communication with our support team.

12.2 Chargebacks and Payment Disputes

Filing a chargeback or payment dispute with your bank or payment provider without first contacting us and allowing a reasonable time (at least 5 business days) for resolution may result in immediate account suspension and termination of services. We reserve the right to contest any chargeback we believe is unwarranted based on our service records, usage logs, and these Terms.

12.3 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any claim arising from your use of the Service must be filed within one (1) year after the cause of action arises, or the claim shall be permanently barred.

We reserve the right to modify, update, or revise these Terms at any time to reflect changes in our services, legal requirements, or business practices. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. We will make the updated Terms available on this page with a new "Last Updated" date. For material changes that significantly affect your rights, we may provide additional notice through the Service interface or via email.
